International Virtual Learning Academy’s (IVLA) Commitment to Privacy

IVLA is determined to make your child’s educational experience personalized, motivational, and convenient. As part of this experience, we gather certain types of information about our online learners, and we want you to fully understand the terms and conditions surrounding the use of the information we collect.

This Privacy Policy lets you know how we collect, use, share and protect information that we may gather from our website ( and those of our affiliates, Global Student Network (, and United Digital Learning ( (collectively, “Sites”). This policy also applies to information that we may collect from you outside of our Sites, such as over the phone, by fax, through conventional mail, or by other means. By using any of our Sites, you agree to accept the terms of this Privacy Policy that are in effect at the time of use, including any provisions pertaining to changes to the Privacy Policy.

Definitions applicable to this Privacy Policy

IVLA means International Virtual Learning Academy and all of its Affiliates. An “Affiliate” of IVLA is an entity that controls, is controlled by, or under common control with IVLA, where “control” means the possession, directly or indirectly, of the power to direct or cause the direction of the management policies of an entity, whether through the ownership of securities, by contract, or otherwise.

“PII” means Personally Identifiable Information. PII is information that, alone or in combination, is linked or linkable to a specific person that would allow a reasonable person, who does not have personal knowledge of the relevant circumstances, to identify the person with reasonable certainty.

Laws that are generally applicable to student records

Your child’s education records will be protected by IVLA as required by the Family Educational Rights and Privacy Act (“FERPA”) ( and applicable state laws regarding the privacy of student records or PII. IVLA will only disclose education records or provide access to them in compliance with FERPA and applicable state laws, and we will require third parties that contract with us and have access to education records to do the same. IVLA will not use PII to target a student for advertising, sell PII, and/or use PII to create profiles about a student (other than for purposes of the student’s education) when those activities are prohibited by law. IVLA will not use, without prior permission having been granted to IVLA, a student’s PII for purposes unrelated to providing or improving the student’s educational experience where required to do so by law. If any provision of IVLA’s Privacy Policy conflicts with FERPA or other federal or state law, IVLA will comply with the more protective standard for the student’s education records.

Non-personally identifiable information collected by IVLA

Each time you visit the IVLA Sites, non-personally identifiable information is automatically entered into an information system. Such information includes your IP address (that is, the unique string of numbers that identifies the device you are using to communicate over the internet), the name of the webpage from which you accessed our Site, the page or pages you visit on our Site, and how much time you spend on each page.

IVLA’s use of non-personally identifiable information

IVLA uses this information to both monitor/improve our Sites and for internal analysis. We use IP addresses to analyze traffic trends, administer the Sites, and gather information for aggregate use. IVLA does not link IP addresses to PII, whether the IP addresses are alone or in combination with other non-PI.

When does IVLA share non-personally identifiable information?

IVLA will neither share (except with respect to “cookies”) nor sell non-PII to any third party, except (i) if IVLA is required to do so by law, such as by a court order, (ii) if IVLA is permitted to do so for law enforcement, health, and/or safety purposes, (iii)  to third parties that use it in connection with providing services related to your child’s educational experience, or (iv) as permitted to protect IVLA’s legal rights.

IVLA’s use of “cookies” on our Sites

A “cookie” is a text file that is placed on your device by a Web page server. IVLA’s Sites use “cookies” to help personalize your child’s online educational experience. Cookies are uniquely assigned to the device, but do not collect PII. IVLA uses cookies to keep track of how you are using our Sites so we may better tailor our Sites’ content to your specific interests. If you have enrolled your child in an IVLA School Program, cookies will ease your access to our Online School (“OLS”) while also improving your ability to navigate our Sites. IVLA cookies do not contain personal information about the parent(s) or the child (children), nor do our cookies run programs or deliver viruses to your computer.

IVLA may use third-party cookies of other vendors (such as, but not limited to, Google), to help provide you with relevant information as you use both our Sites and the internet. These third-party cookies may record that you visited our Sites, as well as the websites that you visited prior to visiting our Sites. Such cookies can then be used to deliver relevant messages to you on other websites. These third-party cookies do not collect PII.

Please know that you have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but in most cases, you can modify your browser settings to decline cookies. Should you choose to decline cookies, please note that (i) you may not be able to fully experience the interactive features of our Sites and (ii) some of our services on the Sites may not function properly.

You may choose to opt out of the use of third-party cookies for marketing messages on other websites by visiting the Digital Advertising Alliance Consumer Choice Page and opting out with those companies that participate in those choices. IVLA’s sharing of information collected from cookies

IVLA does not disclose, share, and/or sell non-aggregated information contained within cookies to third parties, except when IVLA is required to do so by law, such as by a court order, or when IVLA is permitted to do so for law enforcement purposes. IVLA may also share non-aggregated information contained within cookies in order to keep track of how you are using the Sites to better tailor our Sites’ content to your specific interests.

Personally identifiable information collected by IVLA

You can use portions of our Sites without divulging any PII. Our Sites do not collect personal information about individuals except when such individuals specifically provide personal information on a voluntary basis (for example, when registering with IVLA; requesting additional information by contacting IVLA; signing up for an IVLA in-person event; posting a message to a message board; requesting help; engaging in an online chat; or accessing, adding to, and/or changing your IVLA account information). When you register your child with IVLA, please note that you are providing us with information regarding both you and your child. This personal information may be collected on our Sites, or via telephone, facsimile, and/or conventional mail. The types of information that you may be asked to provide, which depends on the services you choose to receive, include, but are not limited to, (i) first and last name, (ii) postal address, (iii) telephone number,(iv) the names and ages of your children, (v) the services you request, (vi) registration and enrollment information about your child, (vii) an e-mail address where we can contact you, and (viii) credit card information.

IVLA’s sharing of personally identifiable information

Registration and enrollment information that you provide may be provided to third parties as required by state or federal law. Information provided by you, or your child, may be provided to state and federal agencies, including law enforcement, as may be required or permitted by law.

To the extent that third-party vendors assist IVLA in providing your child’s educational experience, those vendors are provided the minimum amount of data required to perform the tasks for which they have been engaged, consistent with legal requirements such as FERPA. These third-party vendors have no independent rights to such data and they have agreed to maintain the confidentiality of any data received from IVLA. They have also agreed to use any data received from IVLA for the sole purpose of performing the tasks for which they have been engaged and to safeguard said data as required by law and/or contract.

IVLA may share your information, as permitted by state and federal law, with companies that are not affiliated with IVLA but that are interested in sending you information about their products and services. Also, as permitted by applicable state and federal law, IVLA may share your information with other companies so as to improve your child’s educational experience, so IVLA may offer its products and services to you, and/or provide you with information about the products and services of third parties. You can request that your personal information not be shared with third parties by making a request in writing to

IVLA’s use of personally identifiable information

IVLA may use your PII in the course of providing your child’s educational experience and to otherwise support both you and your child with regard to matters such as testing, academic progress, attendance, customer service, student affairs, and/or for health or safety purposes. As previously stated, IVLA may also use PII to protect its own legal rights.

IVLA responds to customers who have requested information from us and/or to answer questions that have been directed to us. When providing requested information and/or answering questions, IVLA only calls customers at the telephone numbers they leave for us. IVLA does not call people by generating random or sequential telephone numbers. IVLA may use pre-recorded messages when allowed by law in order to provide our customers with the information they requested, and/or to answer any of their questions, in a timely manner. Our valued customers do not have to consent to receive calls in order to receive IVLA’s services.

Once you have registered your child in an IVLA Program (whether you registered on our Sites or through offline communications), there will be a personal information page on the OLS that contains some, or all, of your personal information. You, or your child, will also be assigned a Student ID and password so you may log in to the OLS. The Student ID will be used by IVLA to recognize you and your child on the OLS. The Student IDs will allow IVLA to recognize important information such as (i) your first and last name, (ii) your child’s first and last name, (iii) your home address, (iv) your child’s date of birth, (v) the parent’s date of birth, (vi) your phone number, (vii) your email address, (viii) your child’s course curriculum, (ix) and your child’s grade level. The Student IDs and the OLS will also allow both you and IVLA to track your child’s school work, testing, and overall educational experience in a manner consistent with state and/or federal standards and regulations.

IVLA may use PII provided by you in the OLS to contact you and/or your child’s learning coach about your child’s progress, testing, attendance, and/or other school-related matters. IVLA may also use PII provided by you for customer service and quality control matters. The PII may also be used to deliver requested services to you and/or your child.

IVLA may use and/or share PII if required to do so by law, such as in response to a court order. IVLA may also use/share PII, if permitted to do so, for law enforcement, health and/or safety matters, and to protect IVLA’s legal rights. Furthermore, if permitted by applicable state and federal law, IVLA may use/share your PII to provide you with information about new IVLA products and services. IVLA may also aggregate PII in an effort to improve your child’s educational experience or to determine how IVLA’s educational products and services may interest other persons.

IVLA’s treatment of information about children under the age of thirteen (13) years old

IVLA understands that children who are under thirteen (13) years of age need enhanced safeguards and privacy protection, as set forth in the Children’s Online Privacy Protection Act (COPPA). COPPA was enacted to protect the information privacy of children under the age of 13 by requiring website operators and online services to post privacy policies and obtain verifiable parental consent before collecting information from those children.

Personal information about children under the age of 13 is only received by IVLA from the parents or guardians of said children who have enrolled in IVLA. The only information received by IVLA that comes directly from your child is the information they provide in the OLS as part of their educational experience. Such information consists of test answers, electronic mail, and class discussions. IVLA does not knowingly contact or collect PII from children under the age of 13.

California privacy rights

California’s “Shine The Light” law, which was passed in 2003 (California Senate Bill 27 (S.B. 27)), allows California residents to opt-out of IVLA’s disclosure of PII to third parties for the purpose of direct marketing. On January 1, 2016, the Student Online Personal Information Protection Act went into effect in California. IVLA will protect “covered information” consistent with the terms of this new law.

Information collected and/or shared on message boards and chats

IVLA may offer, at its sole discretion, message boards and/or chat rooms on our Sites. If such message boards and/or chats are available on our Sites, please note that others may read your postings on a message board and/or in a chat room. All information posted on a message board or in a chat room is available to all other users of that message board or chat room, which means said information is no longer private. Please note that IVLA cannot guarantee the security of information that has been disclosed and/or communicated online in public areas such as message boards and chat rooms. The posting of any information in a public forum such as message boards and chat rooms is done at your own risk. IVLA reserves the right, but not the obligation, to monitor any and all content that is posted on the message boards and/or chat rooms contained on our Sites. IVLA also reserves the right, but not the obligation, to republish, at IVLA’s sole discretion, your postings from message boards and/or chat rooms contained on our Sites.

Linking to other websites, chat rooms, or resources from IVLA’s Sites

IVLA’s Sites may contain links to other websites, chat rooms, and/or other resources that we provide for your convenience (“Linked Sites”). Please be aware that these sites are not under the control of IVLA and that IVLA is not responsible for the content available on any Linked Sites nor is IVLA responsible for the actions of any Linked Sites. Also, please understand that such links do not imply, in any manner, that IVLA endorses the material and/or actions related to these Linked Sites. Furthermore, IVLA expressly disclaims all liability with regard to your access to such Linked Sites. Access to any, and all, websites linked to the Sites is done so at your own risk. IVLA encourages you to review the specific Privacy Policy related to any Linked Sites as those websites are not covered by IVLA’s Privacy Policy.

IVLA’s commitment to data security

In an effort to reduce the risk of unauthorized access, maintain data accuracy, and ensure the correct use of information, IVLA has put in place reasonable physical, electronic, and managerial procedures that are intended to safeguard and secure all information collected by IVLA. Secure Sockets Layer (SSL) protocol is also utilized on your account information and registration pages in an effort to better protect sensitive personal information. IVLA also encrypts credit card numbers that were provided to us during the enrollment process. Despite our very best efforts to provide maximum data security, please understand that no security system is impenetrable, which means that IVLA cannot guarantee that PII that was supplied by you cannot, and will not, be intercepted by others.

Changes in IVLA’s corporate structure

Should IVLA, or any part of IVLA, be sold, merged, or otherwise transferred to another entity, the personal information provided by you at our Sites may be transferred as part of that transaction/process. In the event that such a sale, merger, and/or transfer occurs, IVLA will take steps to assure that all PII is used in a manner consistent with the IVLA Privacy Policy under which it was collected. Furthermore, please know that the Family Educational Rights and Privacy Act protects your child’s educational records in the event of such a transaction or transfer.

Changes in this Privacy Policy

From time-to-time, and at IVLA’s sole discretion, this Privacy Policy may be amended to reflect changes in IVLA’s privacy policies and procedures that are deemed necessary by IVLA management, customer feedback, and/or changes in the law. IVLA reserves the right to change, modify, add, and/or remove portions of this policy at any time and at IVLA’s sole discretion. Should IVLA choose to materially change the manner in which it uses your personal information, IVLA will announce such changes on its Sites while also noting it in this Privacy Policy. Should IVLA make any changes to this Privacy Policy, we will post the revised policy on our Sites. The effective date of this Privacy Policy is documented below and reflects the most recent update of this Privacy Policy.
